Most likely somewhere between 1:22 and 1:20.
George Scheyer has a couple of pics with it against a 1:20 Shay and a 1:29 Pacific.
Its pretty obvious it aint 1:29.
They are supposed to be 1:24 although they look fine as a 1:20.3 industrial loco. The tender is a later addition and looks rather odd being 1:29 and from a different time period.
I have a couple of tatty old Rogers loco put by to bash into 1:20 scale industrial locos. All they need is the front pony truck, cow catcher and smokebox extension removed. If you change the cab as well for a spectical plate they even look like a British early Hawthorn contractors 3' gauge loco.
Steve i can't remember which books they are in but if you search the web for 19th century industrial narrow gauge locos you will find some eventually.
The Aristo model is modelled in rebuilt condition. If you you cut of the smokebox extension (you can see a line with rivets each side) and replace the dog latch smokebox door with a a lift up semi circular flap door, combined with removing the front truck and moving the buffer beam back close to the smokebox and fitting an open cab it will look like an 1880's loco built by several makers in both the US and UK.
